Gallery terms & conditions

These Terms and Conditions govern the relationship between Art Gallery (referred to as the Wealth Art Gallery and all parties engaging in business with us, including artists, art consultants, agents, buyers, and visitors. By collaborating with or using the services of the Gallery, you agree to the following terms:

1. General Terms

The Gallery operates as a curated space for exhibitions, sales, and artist representation.

All transactions, submissions, and partnerships are subject to approval by the Gallery.

The Gallery reserves the right to modify, update, or amend these Terms & Conditions at any time.

 

2. Artist Representation & Submissions

Artists submitting work must ensure that all artworks are original and available for sale unless otherwise stated.

The Gallery reserves the right to curate, exhibit, and market selected works at its discretion.

If an artist’s work is accepted, a formal agreement will outline exhibition dates, pricing, and commission structures.

Artists must provide high-quality images and accurate descriptions for promotional use.

 

3. Sales, Commission & Payment Terms

The Gallery handles all artwork sales, whether through exhibitions, private sales, or online platforms.

The standard gallery commission on sales is 20% gallery, 70% artist, unless otherwise agreed.

Payments to artists and agents will be processed within [Specify Time, e.g., 30 days] after a sale is completed.

Prices set for artworks must be consistent across all selling platforms and cannot be altered without prior approval.

 

4. Art Consultants & Agents

Art consultants and agents must adhere to the agreed-upon commission structures when facilitating sales through the Gallery.

Agents representing artists must obtain written consent before negotiating deals on behalf of the Gallery.

The Gallery is not liable for third-party agreements made outside of our official partnership terms.

 

5. Artwork Handling, Shipping & Insurance

The Gallery takes reasonable care of all artworks during exhibitions and storage but is not responsible for loss, damage, or theft unless otherwise stated in a written agreement.

Artists and buyers are responsible for shipping and insurance costs, unless specified otherwise.

Any artwork not sold during an exhibition must be collected by the artist or agent within 30 days after the event ends.

 

6. Intellectual Property & Promotional Rights

The artist retains full copyright of their work. However, the Gallery reserves the right to photograph, promote, and use images of the artworks for marketing purposes, including but not limited to the Gallery’s website, social media, and press materials.

No artwork may be reproduced, copied, or sold by a third party without explicit permission from the artist and Gallery.

 

7. Buyer Policies

All sales are final unless an artwork is received in a damaged condition.

The Gallery does not guarantee returns or refunds unless explicitly stated in a sales agreement.

Buyers are responsible for ensuring the artwork is suitable for their space before purchase.

8. Confidentiality & Ethical Conduct

All pricing agreements, sales records, and client details are confidential and must not be shared without consent.

Any breach of confidentiality or unethical business practices may result in termination of the partnership.

 

9. Dispute Resolution & Termination

Any disputes between the Gallery and artists, agents, or buyers will first be attempted to be resolved through negotiation and mutual agreement.

If an agreement cannot be reached, legal action may be taken in as per local business laws.

The Gallery reserves the right to terminate any partnership without prior notice if these terms are violated.
